On Friday, July 25, 2025, the fourth day of the 39th sitting of the 10th term of the Sejm, Members of Parliament adopted the Senate’s amendments to the government’s draft law of April 8, 2025, on special rules for the preparation and implementation of strategic and key investments related to national defense and public security needs, as well as the establishment of protective zones for certain restricted areas.

As Deputy Minister of National Defense Cezary Tomczyk reports, “the Parliament sent a clear signal: zero recalcitrance, full mobilization — 431 MPs and 83 senators voted in favor. The special act passed virtually unanimously and now awaits only the president’s signature.”
The special legislation is designed to streamline all stages of defense-related investments, from site selection and property acquisition to obtaining permits by up to 70%, thanks to a single, integrated administrative decision issued by the voivode. It exempts key investments from lengthy environmental procedures. The new regulations will apply to entities under the Ministry of National Defence and the Ministry of the Interior and Administration, as well as companies from the Polish defense industry. According to the Ministry of National Defence, this represents tangible support for Polish arms manufacturers and effective expansion of the national capacity to produce military equipment and ammunition. Any investment included on a special list maintained by the Minister of National Defense will be subject to the new regulations.
The act also lays the legal groundwork for adopting the National Defence Readiness Program, which will define clear objectives, costs, and timelines. It prioritizes investments carried out under the National Deterrence and Defence Programme – East Shield.
The introduction of special provisions also allows for the purchase of unmanned aerial vehicles (UAVs) and anti-drone systems without applying the public procurement law, provided that the equipment passes military testing and receives a recommendation from the Ministry of National Defense. These tests may be conducted by organizational units subordinate to the Minister of National Defense, including military research institutes capable of evaluating the performance of such systems. This solution also gives the green light to domestic manufacturers.
The act introduces the possibility of establishing protective zones around restricted areas, which will be subject to new land-use regulations.
Although the law significantly accelerates processes, it does not disregard environmental concerns. For Natura 2000 areas, procedures for minimizing or compensating for environmental impact are still required.
The new provisions also apply to properties used as family allotment gardens (ROD). If liquidation, in whole or in part, would be necessary, it will be carried out in accordance with the Act on Family Allotment Gardens of December 13, 2013.
Allotment holders will be entitled to replacement compensation, meaning they will have the right to recreate their gardens in a new location under the conditions set out by law.
